A writ is a directive from this court to a trial court, an administrative agency, or a person to do something or to stop doing something. Unlike appeals, which are heard as a matter of right, writ petitions are generally heard as a matter of discretion, and they are governed by equitable principles.

If a single document contains both an order granting a motion for summary judgment and a judgment, it is an appealable order. An order granting or denying a request for an injunction, or granting or denying a request to dissolve an injunction. An order directing a party to pay an amount of money over $5,000.

What is an Order to Show Cause? An Order To Show Cause is a court order requiring the involved parties to explain, prove, or justify an event, action, behavior, or other factor affecting the case at hand. In California, this is also commonly referred to as a Request for Order (ROF).

(d) Order to show cause If the petitioner has made the required prima facie showing that he or she is entitled to relief, the court must issue an order to show cause. An order to show cause does not grant the relief sought in the petition.

The order to show cause must be made returnable on the earliest date that the business of the court will admit, but not later than 15 days or, if good cause appears to the court, 22 days from the date the order is issued.

To file a petition for a writ in the appellate division, you must bring or mail the original petition, including the supporting documents, and the proof of service to the clerk for the appellate division of the superior court that took the action or issued the ruling you are challenging.
