The length of time you can stay out on workers' compensation will range from 225 to 525 weeks. However, the number of weeks and amount of money you can collect from workers' comp for your work-related injury each week will vary, depending upon your individual circumstances.

Voluntary Short Term Disability You can receive income replacement benefits for up to 26 weeks. An employee working at least 50 percent of full time on a regular appointment and whose annual salary is at least $15,000 is eligible to enroll in the plan.

The Disability Benefits Law (Article 9 of the WCL) provides weekly cash benefits to replace, in part, wages lost due to injuries or illnesses that do not arise out of or in the course of employment (WCL §204). Medical care is the responsibility of the employee and is not paid for by the employer or insurance carrier.

Since workers' compensation and SSD are two separate entities, receiving one does not disqualify you from collecting the other.

Disability benefits are equal to 50 percent of the employee's average weekly wage for the last eight weeks worked, with a maximum benefit of $170 per week (WCL §204).
