Are Leave of Absences Paid or Unpaid? For the most part no, by law, you as an employer are not required to pay your employees during a leave of absence. The only situation where you must pay is if the leave of absence is due to domestic violence or sexual assault.

The leave entitlement is up to 104 weeks of leave. It is required that the leave be taken in a single period. If an employee is charged with a crime in relation to the death of the child or if the child was a party to a crime in relation to their death, there is no entitlement.
