The Hazardous Waste Generator Improvement Rule, signed by the Environmental Protection Agency, aims to simplify hazardous waste management in allowing flexibility for generators to dispose of hazardous waste. In doing so, the rule offers increased environmental protection.

Each generator that generates 1000 kg/month or more of hazardous waste per calendar month must comply with the requirements of 22 CCR division 4.5, chapter 15, article 4. These requirements include: The generator must prepare and retain a written contingency plan and emergency procedures for dealing with emergencies.

Therefore, it is the responsibility of each generator to identify any and all hazardous wastes that he or she might be producing, and to assure the waste is handled in a manner consistent with the EHS requirements listed in this document.

The three possible generator categories are Conditionally Exempt Small Quantity Generator (CESQG), Small Quantity Generator (SQG) and Large Quantity Generator (LQG).

Since May, US EPA has authorized several state authorities to enforce new and revised hazardous waste regulations, including changes from the Generator Improvements Rule. North Dakota on October 19, 2022. Virginia on October 18, 2022. Tennessee on July 13, 2022. Michigan on June 15, 2022. Hawaii on May 3, 2022.

Conditional Exempt Small Quantity Generators (CESQGs) What is a CESQG? A CESQG generates the smallest amount of hazardous waste and as a result is the least-regulated type of hazardous waste generator.

The generator regulations ensure that hazardous waste is appropriately identified and handled safely to protect human health and the environment, while minimizing interference with daily business operations.

Section 260.10 defines a generator as "any person, by site, whose act or process produces hazardous waste identified or listed in Part 261 or whose act first causes a hazardous waste to become subject to regulation." This definition contains three important terms you need to understand to apply the generator ...

Generators of hazardous waste are regulated based on the amount of hazardous waste they generate in a calendar month, not the size of their business or facility.

The three possible generator categories are Conditionally Exempt Small Quantity Generator (CESQG), Small Quantity Generator (SQG) and Large Quantity Generator (LQG).
