A summons is a written order, issued by the court after a criminal or traffic complaint has been filed, that requires the person named in the complaint to appear in court on a specific date and time to answer the alleged charge.

Similar to a subpoena, a summons is a legal document that must be served personally on the accused. It must be authorized by either a Justice of the Peace or a Provincial Court Judge in Ontario.

Summons to Witness (also known as a “subpoena”) A Summons to Witness is a court order requiring the witness to come to court. Witnesses must appear in person in the courtroom for the trial. The prosecutor is not required to subpoena or call anybody as a witness on your behalf.

An appearance notice and a summons tell a person they must appear in court to respond to a criminal charge.

A summons is a court form which notifies the defendant that they are being sued and lists the day the defendant needs to appear in court (the Return Date). The court has no power to hear a case until the defendant is served the summons and complaint. The plaintiff selects both the Return Date and the trial date.
