You can sell your home with or without a Pool Safety Certificate, Form 23. If you are selling with a pool safety certificate, you must give the buyer a copy prior to settlement. You can access a copy of the certificate on the pool register.

If a non-compliance certificate is in effect, the owner must supply a copy with the sale contract. The obligation to fix defects and obtain a compliance certificate is transferred to the purchaser on settlement. The buyer has 90 days after settlement to make the pool or spa compliant.

All new swimming pools need building development approval and must comply with the pool safety laws. You should also contact a building certifier or your local council for information about building development approval for pools. Pool safety laws apply to both outdoor and indoor swimming pools.
