What is an Article 81 Guardianship? An Article 81 Guardianship is a legal proceeding under NYS Mental Hygiene Law in the Supreme Court for individuals who lack mental capacity to execute advance directives or whose advance directives are not comprehensive.

In Texas, a person does not have a guardian until an application to appoint one is filed with a court, a hearing is held and a judge appoints a guardian. When the court appointment is made, the person the guardian cares for becomes a ward of the court.

Under Texas law, a Guardian of the Person with full authority has the right to have possession of the ward and establish the ward's residence. The guardian also accepts the duty to provide care, supervision, and protection for the ward as well as to provide them with food, clothing, medical care, and shelter.

Rule 10-206 - Annual Report-Guardianship of a Minor or Disabled Person (a) Report Required. Other than a temporary guardian, a guardian of the person of a minor or disabled person shall file an annual report in the action.
