Termination of Parental Rights A termination of parental right happens when a city agency (like NYC Administration for Children's Services - ACS) or foster care agency files a petition in Family Court asking a Judge to end a parent's parental rights. The petition must give a ground (legal reason) for the termination.

You should contact the court clerk and ask. In Tarrant County, for example, you must pay $315.00. In Dallas County, you will pay $318.00. In Harris County, the fee is $267.00.

Parental responsibility is only terminated where it is necessary in order to protect the child from serious emotional or physical harm. Terminating parental responsibility should only be used “where the circumstances really do warrant it and not otherwise”.

If an unmarried father has gained parental responsibility by parental responsibility agreement or court order then an application can be made to court to remove his parental responsibility for the child.
