The Age Discrimination in Employment Act of 1967 (ADEA) protects employees who are 40 years old or older from age discrimination. The Older Workers Benefit Protection Act of 1990 (OWBPA) strengthened the protections of the ADEA with respect to employee benefit plans.

The New Hampshire "Law Against Discrimination" is contained in NH RSA 354-A, and covers employment, housing, and places of public accommodation. The Commission adopts rules pursuant to RSA 541-A, the Administrative Procedure Act, in ance with the procedures set forth in the Act.

This means that all employees or individuals who work to provide or administer programs and services on behalf of the State of New Hampshire, including teachers in an educational setting, must continually strive to treat all of those with whom they may come into contact equally and with dignity and respect.

The federal Fair Housing Act now includes seven protected classes: race, color, national origin, religion, sex, familial status and disability. New Hampshire's housing discrimination laws expand protection to three additional groups based on age, marital status or sexual orientation.

New Hampshire's employment non-discrimination laws forbid discriminating against someone because of sexual orientation as well as age, sex, race, color, marital status, physical or mental disability, religious creed, or national origin (NH RSA 354-A:7).

We are a state agency established by RSA 354-A for the purpose of enforcement of the law against discrimination in employment, public accommodations, public education and the sale or rental of housing or commercial property, because of age, sex, sexual orientation, gender identity, race, creed, color, marital status, ...

Likewise, New Hampshire's anti-discrimination law, RSA 354-A:7, VI(a), provides that the word “sex” includes pregnancy and medical conditions which result from pregnancy. An employer may not terminate an employee because she is pregnant.
