En caso de siniestro, el conductor o propietario del vehículo asegurado o sus representantes estarán obligados a dar aviso escrito a la entidad aseguradora dentro de 30 días, contados desde que tenga noticia del accidente, salvo caso de impedimento debidamente justificado.

Según el artículo 16 de la Ley 50/80 del Contrato de Seguro (véase), el tomador del seguro, asegurado o beneficiario del mismo debe comunicar el acaecimiento de un siniestro dentro del plazo de siete días a partir del momento de haberlo conocido.
