OKLAHOMA'S NEW THIRD GRADE RETENTION LAW In 2011, Oklahoma amended the Reading Sufficiency Act (RSA) to require schools to retain students who do not pass a reading test and do not meet other criteria for exemptions by the end of the third grade.

Lawmakers passed the third grade retention law during a special education-focused legislative session in 2021. It requires third graders who fail to “meet” or “exceed expectations” on the spring TCAP test to repeat the grade. Students can avoid retention by attending summer school or tutoring programs.

A student will only be retained in grade 3 once. If your child does not score at Level 2 or above, you will be notified by the school that your child will not be promoted to grade 4 until he or she achieves the required reading level.

Third graders are exempt from retention if they were retained in a previous grade; have or may have a disability that affects reading; are English language learners with less than two years of English instruction; or retest as proficient before the beginning of fourth grade.
