California Rules for Skipping Meal Breaks You may legally waive your meal break if you work more than six hours. But you and your employer must agree to it beforehand, preferably in writing. These “on-duty” paid periods often occur when the type of work you perform prevents you from leaving your workstation.

You must get your entitlement to breaks, so you can't opt out of taking them. But when you take them can be changed through a collective agreement.

Employees working 6 hours or less may waive their meal break by mutual consent of both employer and employee. Employees working more than 10 hours, but less than 12 hours, in one shift can waive their second meal break provided they did not waive their first meal break. Employees cannot waive both meal breaks.

Working lunches and rest breaks You should leave out any lunch breaks where you don't have to do any work. You should also leave out any lunch breaks that you choose to work through. Working time doesn't include rest breaks, so you shouldn't count any time you spend on breaks during or between shifts.

If you're aged 18 or over and work for more than 6 hours a day, you're entitled to: an uninterrupted rest break of at least 20 minutes, taken during the day rather than at the beginning or end (eg tea or lunch break)

Workers have the right to one uninterrupted 20 minute rest break during their working day, if they work more than 6 hours a day. This could be a tea or lunch break. The break doesn't have to be paid - it depends on their employment contract.

If an employee's shift is six hours or less, the meal period may be waived by mutual consent of the employer and employee. So, if an employee works six-and-one-half hours, she and her employer are prohibited from a meal break waiver.

Second 30-Minute Meal Break An employee can waive the second meal period only if all of the following conditions are met: The total hours worked on that workday are not more than 12; You and the employee mutually consent; and. The first meal break of the workday was not waived.
