Is participation in the Work Opportunity Tax Credit program mandatory? The Work Opportunity Tax Credit is a voluntary program. As such, employers are not obligated to recruit WOTC-eligible applicants and job applicants don't have to complete the WOTC eligibility questionnaire.

The employer and the job seeker must complete the Pre-Screening Notice and Certification Request for the Work Opportunity Tax Credits, IRS Form 8850 and sign under penalty of perjury, attesting that the job seeker is a member of a target group.

Don't file Form 8850 with the IRS. Instead, you must submit it to the SWA of the state in which your business is located (where the employee works) generally no later than the 28th calendar day after the date the individual begins working for you. Submitting Form 8850 to the SWA is listed in Rev.
