You may pay without surcharge at 3 to 3.5 years, 7 to 7.5 years, and 11 to 11.5 years after the date of issue. You cannot pay early. You may also pay with a surcharge during the "grace periods" at 3.5 to 4 years, 7.5 to 8 years, and 11.5 to 12 years after the date of issue.

The payment of the issue fee due may be simplified by using a U.S. Patent and Trademark Office Deposit Account or a credit card payment with form PTO-2038 for such a fee. See MPEP § 509. However, any such payment must be specifically authorized by reference to the “issue fee” or “fees due under 37 CFR 1.18.”

If the patent holder fails to pay the maintenance fees by the end of the grace period, the patent will lapse, and the patent holder cannot enforce any rights on the patent.

Payment of the Issue Fee If the issue fee is not submitted in time, the application will be regarded as abandoned. However, the patent office may accept a late payment of the issue fee if the delay is shown to be unavoidable.

It's too late to file a continuation application after the parent patent application has issued. Therefore, it's critical to plan ahead and time the payment of the issue fee to give yourself enough time to file the continuation.

We accept credit cards, debit cards that do not require a PIN, deposit accounts, or EFT when paying online. Guest users can only pay with a credit or debit card, but signed in USPTO.gov account users can pay with any payment method stored in Financial Manager.

The issue fee and any required publication fee are due 3 months from the date of the Notice of Allowance.

The average time that an allowed application is in the FDC process is 5 weeks (2 weeks of processing time for assignment of issue date). The "Issue Notification" is mailed approximately 3 weeks prior to the issue date of the patent.
