Couples do not have to be legally separated before filing for divorce in Colorado, and in fact, some divorces are started while the parties are still living together. If tensions are running high in the home, we often recommend that one of the parties move out while the divorce is pending.

Colorado is a “no-fault" divorce state. This means you don't have to prove any wrongdoing by either spouse. The only grounds for divorce is that the marriage is "irretrievably broken." As divorce can be requested by only one party, there aren't defenses or ways to permanently stop your spouse from requesting a divorce.

How long do you have to be separated before divorce in Colorado? In this state, the legally separated party is required to wait six months before they can pursue a divorce. This means the waiting period begins when the separation decree is put in place and at the end of that six months the spouse may request a divorce.

Once the 6 months have passed, parties can file to convert the Decree of Legal Separation into a Decree of Dissolution of Marriage (divorce).

You only have to tell the court that your marriage is irretrievably broken and that there's no chance that you will reconcile. You must go through a 3-month waiting period.

How long do I have to live in Colorado before I can file for divorce? Either party must reside in Colorado for at least 90 days prior to the filing of the Petition. There is a mandatory 90 day waiting period before the Court can enter the divorce decree.

Colorado is strictly a "no-fault" divorce state. This means judges won't consider either spouse's misconduct or fault (such as adultery or drug abuse) in deciding whether to grant the divorce, how to divide property, or whether to award spousal maintenance (alimony).

You must wait at least 182 days from the date your legal separation was finalized by the court (when the Decree of Legal Separation was entered) before you can file paperwork to change the legal separation to a divorce.
