What is a peace order? It's a court order that requires another person to stay away and refrain from contacting you.

File criminal charges at a commissioner's office or call police, who may arrest someone who violates an order. If found guilty, they face up to 90 days in jail and up to $1,000 in fines. Another option when someone disobeys a court order is called contempt.

You can appeal the issuing of a peace order in Maryland. An applicant can also appeal the decision or a judge not to grant a peace order. Either party can appeal the decision of a district court judge to the circuit court. The appeal is heard as if it's a new case.

Once a peace order is in place, you must abide by it or you risk a violation. If you don't follow the peace order, you can be found guilty of a misdemeanor. This may mean a fine of up to $1,000 and jail for up to 90 days. Those penalties increase if you violate a peace order more than once.

A peace order hearing is public. That means other people will be in the courtroom. The judge will ask whether you want to agree, or consent, to the order. If you agree or consent, there won't be a trial with evidence or testimony.

There is a $46 filing fee and a $40 service fee. The Court may waive only the filing fee for indigent petitioners. For more information about filing fee waivers, visit the Maryland Judiciary's website.

How do I get a peace order? Start by completing a Petition for Peace Order, or form DC-PO-001. You must also complete a Peace Order Addendum (CC-DC-PO-001A) and a Peace Order Supplement (DC-PO-1S). Find the forms online or ask a court clerk or commissioner for blank forms.

It is worth noting that a peace order doesn't go on a criminal record, because it is handled in civil court. However, many who petition for a peace order in Maryland do press criminal charges for one of the above-mentioned acts.
