Who is exempt from overtime and hours of work under this provision? Exception. You cannot refuse to work overtime if it is necessary due to a situation that your employer could not reasonably anticipate and that presents or could reasonably present any of the following imminent or serious threats: to the life, health or safety of a person.

Employees are only entitled to overtime for work that is requested, acknowledged or authorized by the employer. In some cases, employees are not entitled to overtime wages because they have substantial control over their hours of work and earn at least twice the Manitoba Industrial Average Wage.

Standard hours of work are 40 hours per week and 8 hours per day. In most cases, employees who work more than the standard hours they must be paid at the overtime wage rate.

The amount of notice an employee must give depends on how long the employee has been employed by the same employer. The employee must give a week's notice if they have been employed for at least 30 days but less than a year. If their period of employment is one year, then they are required to serve two weeks' notice.

Flextime is an arrangement that allows an employee to alter the starting and/or end time of her/his workday. Employees still work the same number of scheduled hours as they would under a traditional schedule. It is also a flexible work option for positions that do not easily support remote work.
