Progress payments shall not be made in advance of delivery or acceptance of goods or services.

There is no single method of calculating progress payments, but the most common formula is the percentage of completion applied to the total contract price, less retainage which is held by the project owner until final acceptance of the project.

A progress payment is a partial payment approach identified in a contract related to steps or phases toward the completion of the contract for goods and/or services. Use of this payment approach can require withhold of a percentage of payment pending completion of the entire contract and a bond.

(i) The due date for making progress payments based on contracting officer approval of the estimated amount and value of work or services performed, including payments for reaching milestones in any project, is 14 days after the designated billing office receives a proper payment request.

Section 110A(6) of the Act defines the “payment due date” as “…the date provided for by the contract as the date on which the payment is due”.

The due date is the date on which a payment or invoice is scheduled to be received by the nominee. For example, in the case of an electronic funds transfer, the due date is the date that the payment is scheduled to be deposited in the nominee's bank account and available to be withdrawn.

The Payment application is then reviewed by the Architect/Engineer of Record and approved by the project owner (or the owner's representative).
