What is an advance directive? An advance directive is a legal document, written before you have an incapacitating illness, that allows you to state your preferences about medical care. The State of New Hampshire recognizes two forms of advance directives: a Durable Power of Attorney for Health Care and a Living Will.

The New Hampshire medical power of attorney form, or advance directive form, is a dual-purpose document consisting of a durable power of attorney for health care and a living will. A person can choose to execute both sections of the advance directive, or they may choose only to complete one or the other.

The two most common advance directives for health care are the living will and the durable power of attorney for health care. Living will: A living will is a legal document that tells doctors how you want to be treated if you cannot make your own decisions about emergency treatment.

Under a durable power of attorney for health care, the agent's authority shall be in effect only when the principal lacks capacity to make health care decisions, as certified in writing by the principal's attending physician and filed in the principal's medical record.

Advance directives generally fall into three categories: living will, power of attorney and health care proxy.
