Under the Freedom of Information (FoI) Act, anyone can request (and, subject to certain exemptions, receive) information held by a public authority. A request for information must be made in writing by letter, email or fax, provided it is received in legible form and is capable of being used for subsequent reference.

'Failure to disclose' means as an act of a seller to refuse to provide or disclose essential information about a property to a buyer. What qualifies as essential information is any potential problem and material defect that could easily affect the value of the property being transacted.

Normally a refusal to disclose information should be provided in writing, and should indicate the reasons on which the refusal is based. If the body informs you orally that your request is being refused, ask for written confirmation of this, along with the reasons.

The Parties agree not to disclose to each other any sensitive, non-public, personally identifiable information (such as social security numbers, personal credit card information or health care data, etc.)
