In order for an administrative judge to consider a light-duty job offer in assigning an earning capacity to an employee, he must find that the offer is "bona fide." This means that the job must 1) be available and 2) the employee must be able to do it.

What exactly is a bona fide offer of employment? It is an employer's letter offering modified or alternate work to an employee within his/her medical restrictions.

Bona Fide Offer of Employment means a definite offer paying wages of at least the applicable state minimum wage. The employment may be on a shift; full or part-time up to 40 hours per week; and temporary, seasonal or permanent.

A modified schedule may involve adjusting arrival or departure times, providing periodic breaks, altering when certain functions are performed, allowing an employee to use accrued paid leave, or providing additional unpaid leave.

Replacing broken faucets, light bulbs, cracked mirrors, or repairing/ caulking windows that may be not closing properly can also help. These jobs can in clued answering the phone, taking sales orders from clients, copying materials for files, or scanning paperwork for example.

Employees can work a maximum of 90 days within a 12-month period. In some cases, if the treating doctor provides evidence that the employee can return to his or her regular position after an additional 90 days, the employee can work an additional 90 days of light duty work.

If your employer refuses to accommodate your need for work restrictions that result from an injury-related disability, you should speak with a lawyer about your legal rights. The same is true if your employer truly cannot accommodate your work restrictions for any reason.

Modified work – Work in which obstacles that may keep you from performing your essential job functions are adapted, altered or removed. Light duty work – Work in which the job is executed at reduced physical levels. Tasks can be temporary or permanent.
