§37-6-30. Landlord to deliver premises; duty to maintain premises in fit and habitable condition.

To evict a tenant with no lease or a “tenant at will”, a landlord must serve them an X-Day Notice to Quit. The proper notice period a landlord gives depends on the length of rental period. If the tenant pays rent weekly, a landlord has to serve them a 7-Day Notice.

A West Virginia month-to-month rental agreement is a short-term lease that ends when written notice is provided by either the landlord or tenant. The minimum required notice period is thirty (30) days. If not notice is made the lease will continue for an indefinite period.

A West Virginia Lease Termination Letter Form (30-Day Notice) is a legal document that is used by either the tenant or the landlord for the purpose of serving at least thirty (30) days notice of the end of a tenancy. This document will maintain compliance to state law and most rental agreements, for either party.

NOTE: Under Virginia law, if you do not have a lease, and you do not pay rent, you are considered a “tenant at sufferance.” This means you can be evicted for any reason at all, at any time, and no notice needs to be given to you. Under this circumstance you can go from “tenant” to “trespasser” very quickly.

What type of notice does a landlord have to give in a non-payment of rent case? If a landlord wants to evict you for not paying rent, the landlord must give you a written notice to either move or pay rent in 5 days. This is sometimes called a “pay or quit” notice.

Either party may terminate a rental agreement with a term of 60 days or more by giving written notice to the other at least 60 days prior to the termination date; however, the rental agreement may require a longer period of notice.

A landlord is required to provide a tenant a written lease. If there is no lease provided, the law protects a tenant by establishing a statutory lease between landlord and tenant for 12 months, which is not subject to automatic renewal. (§55.1-1204)

The landlord or the tenant may terminate a month-to-month tenancy by serving a written notice on the other at least 30 days prior to the next rent due date, unless the rental agreement provides for a different notice period.
