EC Section 48011 requires a child who has completed a year of kindergarten to be promoted to first grade, unless the parent or guardian and the district agree that the child may continue in kindergarten not more than one additional school year.

Transitional kindergarten “gives students an advantage at kindergarten entry on a range of literacy and mathematics skills,” the study said, adding that “students were also rated as more engaged by their teachers, compared to their peers.”

Children who attend and complete TK then move on to kindergarten the following year. So, a child with a birthday within the TK range will have two years of kindergarten experience before going to first grade.

Nineteen states mandate it as well, but the one with the most school-age children does not and won't anytime soon. On Sunday, California Gov. Gavin Newsom vetoed a law making kindergarten obligatory. He said it would have cost the state about $268 million annually, and there wasn't room in the budget.

Is it mandatory? TK is often described as a steppingstone between preschool and kindergarten, which is now more academically rigorous than it once was. Both TK and kindergarten are optional. Children are only required to attend school in California once they turn 6.

Currently, California, like most states, does not mandate kindergarten. Children who are 5 years old are eligible for kindergarten but are not required to attend school until they are 6 years old.
