This contract requires you to fill out the Seller Property Questionnaire (SPQ) when you are required to fill out the Real Estate Transfer Disclosure Statement (TDS).

This can partially be accomplished by filling out the Transfer Disclosure Statement (TDS). However, sellers typically know more than is asked about on the TDS. This where the California Association of REALTORS® Standard Form Seller Property Questionnaire (SPQ) can help.

PURPOSE: To tell the Buyer about known material or significant items affecting the value or desirability of the Property and help to eliminate misunderstandings about the condition of the Property. ... As the Seller, answer based on actual knowledge and recollection at this time.

Who Must Make These Seller Disclosures in California. As a broad rule, all sellers of residential real estate property containing one to four units in California must complete and provide written disclosures to the buyer.

(C.A.R. Form SPQ, Revised 11/09) This form is not a substitute for the Real Estate Transfer Disclosure Statement (TDS). It is used by the Seller to provide additional information when a TDS is completed or when no TDS is required.

Since the SPQ is required by contract and not required by law. if a seller did not want to provide the SPQ, they could modify the terms of the purchase agreement, typically in a counter offer.
