What is a 302? A 302 commitment in Pennsylvania is an involuntary commitment for psychiatric placement at an inpatient psychiatric unit. In order for a person to be considered for a 302 commitment, a person must meet one of the following criteria within the past 30 days: Imminent risk of danger to themselves or others.

Extended Emergency Involuntary Treatment (“303”) If additional inpatient days are not needed, the individual will be discharged from the hospital within 120 hours. A 303 hearing is held at the treating hospital to determine if further treatment beyond the initial 120 hours is necessary.

you need to be admitted for a short period for further assessment. there's a risk to your safety if you don't stay in hospital, for example, if you are severely self-harming or at risk of acting on suicidal thoughts. there is a risk you could harm someone else. there isn't a safe way to treat you at home.

Longer-Term Inpatient Treatment (304b) Testimony is provided by the treating psychiatrist stating that the patient is still suffering from a severe mental illness and needs further treatment. The mental health review officer can order further treatment for a period not to exceed an additional 90 days.

A 306 transfers an individual from either inpatient to outpatient OR outpatient to inpatient. Example: An individual subject to a 303, 304, or 305 who is currently in inpatient treatment but no longer meets the ongoing criteria for continued inpatient treatment.

A 302-related evaluation can last up to 120 hours, after which the person is either released or, if the doctor finds that the person needs extended treatment, a hearing can be held to extend the person's involuntary treatment.

For this reason, an involuntary commitment is often referred to as a “302.” In Allegheny County, petitions for involuntary commitment are managed and authorized by the Department of Human Services (DHS), through its Mental Health Information, Referral and Emergency Services (IRES) 24-hour phone line.
