DEA Form 41 is used to request permission from the DEA to destroy controlled substances. The only time University researchers use Form 41 is after controlled substances have been lost due to accidentally spilling or breaking a container.

Not all prescriptions for controlled substances can be refilled. Schedule II medications may not be refilled; a new prescription must be written every time. Medications classified as Schedule III or IV controlled substances may be refilled up to 5 times in a 6-month period.

This means that the pharmacy has to fill out the DEA Form 106 within 24 hours of the discovery of the loss. The pharmacy may have to provide the DEA with updated information as it uncovers the source or cause of the loss for up to 2 months after the initial report.
