How Divorce Records are Obtained from the Clerk of Superior Court. If a divorce took place after August 1996, the Clerk of Superior Court in the county where the divorce took place must be contacted. The Clerk is able to conduct a record search at the request of an interested party.

Legitimizing a child born out of wedlock in Georgia requires the marriage of the child's biological parents, or by filing a petiton to legitimize the father's right to the child in superior court within the mother's residential area.

A certified copy of your divorce decree (or any other document from the divorce case) can be obtained ONLY from the Clerk of Superior Court of the county in which your divorce occurred. Court case records, including divorce cases, are public records. Anyone can get them at any time.

It is rare that a petition for legitimation is denied. The only regular reason that it would be denied is if the paternity of the father is at issue. A mother or alleged father can request a paternity test.

Where can I get a copy of my divorce records? You can get a copy of your divorce records at the Closed File Room on the first floor of Fulton County Superior Court, 136 Pryor Street.

You may apply for a TPO in the Magistrate Court office between the hours of 8:00 a.m. to 11:30 a.m. and 1:00 p.m. to 3:30 p.m. on Monday - Friday (excluding county recognized holidays). Click here to download the Temporary Protective Order form.

The Petition for Legitimation must be filed with the court in the child's county of residence. The basic filing fee is $80. If the mother does not acknowledge the petition, she must be served papers by the sheriff, at $25 per address until service is successful.
