A provincial court judge or justice can only modify an existing bail condition with the agreement of the Crown prosecutor. Otherwise, an accused person must bring a formal application to review the bail conditions before a judge in the Superior Court of Justice.

Consent Variations of Judicial Release (Bail) Orders. Section 519.1 of the Criminal Code provides that the conditions of a release (bail) order made by the Court can be varied with the written consent of the accused, the Crown and any sureties.

You can do something about this. There are two stages to cover to vary bail condition. First stage is to write to the police station setting out the reasons why they should vary bail conditions usually to take off the conditions but sometimes to suggest alternatives that are workable.

A bail hearing is when a judge decides whether you should either be kept in jail or allowed to go back to the community while your case is in criminal court. After a bail hearing, you may get bail, which is a court order that lets you stay in the community while your case is in the court system.

How long can police bail last? Under the Policing and Crime Act 2017, police bail can last a maximum of 28 days, during which the police and carry out their enquiries. This means that if you are released on police bail, it should take no longer than a month for a decision to be made.

Yes. This is what is called a bail variation . However, variations can only be done if the Crown agrees to the change, or if the accused applies to a higher court for a review and that court orders the change. An accused should speak to his or her lawyer or duty counsel if they want to have bail conditions changed.

The easiest and most cost-effective way to vary bail conditions is by consent of the Crown Prosecutor. This means that the Crown Prosecutor agrees to changes in the bail conditions. The changes are then presented to a Judge who generally will simply sign off on the variation.

By far the simpler and less expensive method of doing this is a Bail Variation with Crown Consent. Essentially this means a Crown attorney (a prosecutor) and your defence lawyer agree to a certain change in the bail conditions and a Justice of the Peace simply signs off on the agreement.

If the court has given you bail conditions, it is the court who have the power to alter the conditions. The police cannot alter bail conditions given at court. You will need to get in touch with a solicitor who will make an application to the court to vary your conditions.

You will have to get a new surety approved by the court before you can be released. Sometimes, it is possible to change your surety without having to go through the bail court process. This is called a surety substitution. Talk to your lawyer or duty counsel to see if you're eligible for a surety substitution.
