Pursuant to § 63.2-1509 D of the Code of Virginia, a mandated reporter's failure to report as soon as possible, but no longer than 24 hours after having reason to suspect a reportable offense of child abuse or neglect, shall result in a fine.

If there is an investigation in NY by Child Protective Services (CPS), a parent or caretaker has the following rights: 1. The parent or caretaker is not required, unless court ordered, to permit the child protective services representative to enter the residence of the parent or caretaker; 2.

Forcefully Enter Your Home: CPS cannot enter a home without permission unless they have obtained a court order. Compel an Individual to Take a Drug Test: CPS can request that an individual undergo a drug test, but they can only require a parent to do so with a court order.

The SCR is a database that maintains a record of all reports of child abuse and/or maltreatment (neglect) based on calls made to New York State's central hotline. This factsheet explains how SCR reports work and how to challenge them. How can you prepare for your hearing?

If you suspect a child has been harmed or is at risk, please dial 1-800-342-3720, to report what you have seen or heard. You can make a difference. Mandated reporters must file, within 48 hours of an oral report, a signed, written report, Report of Suspected Child Abuse or Maltreatment (LDSS-2221A).

Indicated means that: CPS found enough evidence to support the claim that a child has been abused or neglected. You will receive a letter from CPS called a “Notice of Indication,” telling you that the report was indicated.

CPS may take a child into protective custody if it is necessary for the protection from further abuse or maltreatment. Based upon an assessment of the circumstances, CPS may offer the family appropriate services.

The CPS will only remove your child from your care without asking a judge if he or she determines that the harm or risk to the child is immediate. If the CPS removes your children without asking a judge, the CPS must file a petition in Family Court the very next business day.
