The party demanding a jury trial must prepare and file with the clerk a demand for a trial by jury with an affidavit stating specifically what issues of fact require such a trial and indicating that the jury demand is desired and intended in good faith. There is a required fee to be paid at the time of filing.

New York State Constitution Article 1 §2 Right to trial by jury; waiver thereof. Trial by jury in all cases in which it has heretofore been guaranteed by constitutional provision shall remain inviolate forever; but a jury trial may be waived by the parties in all civil cases in the manner to be prescribed by law.

A jury trial is permitted but not required. That is to say, both parties to a civil lawsuit can elect for a bench trial instead, where the judge alone hears the case and renders a judgment. Typically, the parties inform the court if they want a jury trial when they file their initial pleadings in the case.

The California Constitution, as originally adopted in 1849, set out the right to a jury trial in the strongest possible terms: “ '[T]he right of trial by jury shall be secured to all, and remain inviolate for ever; but a jury trial may be waived by the parties in all civil cases in the manner to be prescribed by law.

Most civil trials in New York use only six jurors instead of the typical 12 in a criminal case. In order to make a decision in a criminal case, jurors usually need to believe the case “beyond a reasonable doubt,” and all 12 of them need to agree.

If you want to have a Jury Trial, tell the judge at your Trial Setting Conference. For more information, see California Code of Civil Procedure section 631 . Each party has to decide if they want a jury trial, or a Court Trial. A court trial is a trial with just the judge.

Any party is entitled to a trial by jury. A written demand for a jury must be filed no later than 14 days before the date a case is set for trial. If the demand is not timely, the right to a jury is waived unless the late filing is excused by the judge for good cause.

In its demand, a party may specify the issues that it wishes to have tried by a jury; otherwise, it is considered to have demanded a jury trial on all the issues so triable.

Also, the party that asks for a jury trial must pay the jury fees. They must pay for every person in the jury every day.

If you want to have a Jury Trial, tell the judge at your Trial Setting Conference. For more information, see California Code of Civil Procedure section 631 . Each party has to decide if they want a jury trial, or a Court Trial. A court trial is a trial with just the judge.
