Power of Attorney broadly refers to one's authority to act and make decisions on behalf of another person in all or specified financial or legal matters. ... Durable POA is a specific kind of power of attorney that remains in effect even after the represented party becomes mentally incapacitated.

A Pennsylvania durable power of attorney is a long-term arrangement between two individuals; the principal (individual implementing the form) and an attorney-in-fact (appointed representative). Pennsylvania law requires that POAs must be signed by the principal and witnessed by two people who are ages 18 or older. The document must also be dated and notarized. In many states, notarization is required by law to make the durable power of attorney valid. But even where law doesn't require it, custom usually does. A durable power of attorney that isn't notarized may not be accepted by people with whom your attorney-in-fact tries to deal.

A Durable Power of Attorney acts as a permission slip, giving authority to a third party to do things on behalf of someone else who cannot do it for themselves. If done properly, the Durable Power of Attorney may very well prevent you from having to be declared incompetent in court if you something bad happens to you.

Finally, a Power of Attorney will end automatically when you die and your agent learns of your death. In some cases, the Power of Attorney will terminate automatically. When you create the Power of Attorney, you can arrange for it to end at a certain time by including an expiration date into the document.
