RCW 4.24. 730. The law states that the employer providing the reference is presumed to be acting in good faith and is immune from civil and criminal liability so long as the information disclosed relates to: An employee's ability to perform his or her job.

Receiving a bad reference can be a real blow both in practical terms and mentally too. They can result in a job offer being withdrawn, or make the process of landing a new job stressful.

New legislation (Chapter 103, Laws of 2005, codified at RCW 4.24. 730) clarifies that employers cannot be held liable for providing job references unless they provide information that is not only false, but is deliberately misleading or made with reckless disregard for the truth.
