Rule 60 - Relief from Judgment or Order (a) Clerical mistakes. The court may correct a clerical mistake or a mistake arising from oversight or omission whenever one is found in a judgment, order, or other part of the record. The court may do so on motion or on its own, with or without notice.

A Motion to Set Aside Default or Judgment is used to ask the court to set aside or "undo" a default or judgment or final order in a case, and to allow the case to move ahead as if the default or judgment had not been made.

To get a judgment by default, you must serve the other party with the Summons and the Complaint/Petition, file proof of service with the court, and then wait at least 21 days (30 days if the other party was served outside Utah).

The statute of limitations for renewing a judgment is 8 years from the date of the judgment. Utah Code Section 78B-2-311. The judgment creditor can file a motion to renew the judgment, but must do so before the statute of limitations expires.

No judgment by default shall be entered against the state of Utah or against an officer or agency thereof unless the claimant establishes his claim or right to relief by evidence satisfactory to the court.

Rule 58A(a) provides, “Every judgment and amended judgment must be set out in a separate document ordinarily titled 'Judgment'—or, as appropriate, 'Decree. '” The rule sets out a few exceptions, mostly for post-judgment motions, and it also establishes a clear process for getting the Court to enter the final Judgment.

The court shall grant summary judgment if the moving party shows that there is no genuine dispute as to any material fact and the moving party is entitled to judgment as a matter of law. The court should state on the record the reasons for granting or denying the motion.
