Affirmative asylum seekers are yet to be deported from the country. While in the case of defensive asylum application, these individuals will have to defend themselves from deportation in immigration court at the U.S. Executive Office of Immigration.

If your asylum application is denied, you will probably be deported. However, there is a process that is followed. For instance, if an application is denied, you will be taken through a removal proceeding that will require you to stand before an immigration court.

Use this form to apply for asylum in the United States and for withholding of removal (formerly called “withholding of deportation”). You may file for asylum if you are physically present in the United States and you are not a U.S. citizen.

A decision should be made on your asylum application within 180 days after the date you filed your application unless there are exceptional circumstances.

For example, you may stop accumulating time toward the 180-Day Asylum EAD Clock if, at a hearing: • You ask for the case to be continued so you can get an attorney; • You or your attorney ask for additional time to prepare the case; or • You request or the parties jointly request administrative closure of your case.

A defensive application for asylum occurs when you request asylum as a defense against removal from the United States. For asylum processing to be defensive, you must be in removal proceedings in immigration court with the Executive Office for Immigration Review (EOIR).

How do I find more information about the 180-day Asylum EAD Clock? Asylum applicants in removal proceedings before EOIR may call the EOIR hotline at 1-800-898-7180 to obtain certain information about their 180-day Asylum EAD Clock.
