Uncontested divorces are not granted to couples with minor children in Texas. Rather, a form of "agreed divorce" is granted. This means you both must agree on all issues related to the divorce (including child custody and child support), and you are both willing to sign all court forms.

After filing the divorce petition, you must wait 60 days before presenting the final divorce decree to the court. Once this mandatory waiting period ends, your attorney will submit your agreed final decree to the court or request a court date to “prove-up” the divorce.

The hearing allows the judge to review each spouse's requests. The judge will then sign the divorce decree to make the divorce final. Unless there was family violence, the judge can't finalize a divorce at the hearing until 60 days after the petition for divorce was filed.

How long will my divorce take? In almost all cases, you must wait at least 60 days before you can finish your divorce. There are only two exceptions to the 60-day waiting period. Both exceptions involve family violence.

File (turn in) your completed answer form with the court. To file online, go to E-File Texas and follow the instructions. To file in person, take your answer (and copies) to the district clerk's office in the county where your spouse filed for divorce. Turn in your answer form (and copies).

The original answer is typically a concise document in response to the basic arguments presented in your original petition. Your spouse may choose to file a counter-petition in which he or she makes her allegations and can request certain relief from the court.

How Much Does an Uncontested Divorce Cost in Texas? The average cost of uncontested divorce in Texas ranges between $300 and $5,000, depending on whether lawyers are involved. In general, it is the cheapest and the quickest option available in any state.

Texas courts try to award joint custody when possible. Joint custody means that the child spends some time with each parent. Although courts favor these arrangements, if one parent is abusive or neglectful, the court can award sole custody to the other parent.
