The legally permissible reasons for taking a hardship withdrawal are very limited. And, your plan is not required to approve your request even if you have an IRS-approved reason. The IRS allows hardship withdrawals for only the following reasons: Unreimbursed medical expenses for you, your spouse, or dependents.

Medical care expenses for you, your spouse, dependents, or beneficiary (The IRS specifies that these may only be unreimbursed medical expenses that are not covered by health insurance) Funeral expenses for you, your spouse, children, dependents, or beneficiary.

Examples of events that may be considered unforeseeable emergencies include imminent foreclosure on, or eviction from, the employee's home, medical expenses, and funeral expenses. Generally, the purchase of a home and the payment of college tuition are not unforeseeable emergencies.

To be eligible for a hardship withdrawal, you must have an immediate and heavy financial need that cannot be fulfilled by any other reasonably available assets. This includes other liquid investments, savings, and other distributions you are eligible to take from your 401(k) plan.

But, there are only four IRS-approved reasons for making a hardship withdrawal: college tuition for yourself or a dependent, provided it's due within the next 12 months; a down payment on a primary residence; unreimbursed medical expenses for you or your dependents; or to prevent foreclosure or eviction from your home.

An unforeseeable emergency is defined as a severe financial unforeseeable emergency to you resulting from: • A sudden and unexpected illness; • An accident you or a dependent experienced; • Loss of your property because of casualty; or • Other similar extraordinary and unforeseen circumstances arising as a result of ...

To make a 401(k) hardship withdrawal, you will need to contact your employer and plan administrator and request the withdrawal. The administrator will likely require you to provide evidence of the hardship, such as medical bills or a notice of eviction.

You do not have to prove hardship to take a withdrawal from your 401(k). That is, you are not required to provide your employer with documentation attesting to your hardship.
