No person shall allow, cause or permit open burning of combustible materials, except as provided in 23.2(2) and 23.2(3). 23.2(2) Variances from rules. Any person wishing to conduct open burning of materials not exempted in 23.2(3) may make application for a variance as specified in 567—subrule 21.2(1).

The Bay Area Air Quality Management District is the public agency entrusted with regulating stationary sources of air pollution in the nine counties that surround San Francisco Bay: Alameda, Contra Costa, Marin, Napa, San Francisco, San Mateo, Santa Clara, southwestern Solano, and southern Sonoma counties.

Burn Notification Form Submission If you choose to burn, you must notify the Bay Area Air Quality Management District (BAAQMD) online or by submitting the Open Burn Form PDF PDF PDF via mail or e-mail. BAAQMD no longer receives notification via fax. The appropriate fees must be paid to BAAQMD prior to burning.
