In order to qualify for disability benefits in New York, claimants must prove that their physical or mental conditions will last at least 12 months. The condition or illness does not need to be occupation-related, but it must prevent claimants from performing their normal work duties.

New York State requires employers to provide disability benefits coverage to employees. These are for an off-the-job injury or illness. The law provides for the payment of cash benefits for employees who: have become disabled from injuries or illness away from work; and. disabilities from pregnancies.

Since workers' compensation and SSD are two separate entities, receiving one does not disqualify you from collecting the other.

Please note: New York State statutory disability benefits (DB) insurance coverage is totally different from and is not included in New York State workers' compensation insurance coverage.
