Part 8 claim: The part 8 procedure is used for claims where the court's decision is on a question where there is unlikely to be a substantial dispute of fact. Part 36 offer: An offer of settlement to try to avoid the matter going to a trial. They must be submitted ance with the rules set out in Part 36 CPR.

Federal Rule of Civil Procedure 8(a) requires a complaint to contain a short and plain statement of the claim showing that the pleader is entitled to relief so as to give the defendant fair notice of the claim and the ground upon which it rests.

A claim form is the document used to start proceedings and contains information relevant to the proceedings including the court reference number to be used on all subsequent court documents, the parties to the proceedings, what is being claimed, particulars of the claim including any claim for interest and contact ...

- A party shall state in short and plain terms his defenses to each claim asserted and shall admit or deny the averments upon which the adverse party relies. If he is without knowledge or information sufficient to form a belief as to the truth of an averment, he shall so state and this has the effect of a denial.

Part 8 procedure differs from Part 7 in that the witness evidence upon which the Claimant wishes to rely, must be served with the claim form and particulars. The Defendants do not have to file a Defence. However, they must file their witness evidence with their acknowledgement of service.

(1) When the claimant files the claim form, they must also file any written evidence on which they intend to rely. (2) The claimant must serve their written evidence on the defendant with the claim form. (3) A defendant who wishes to rely on written evidence must file it when they file their acknowledgment of service.

Under Part 7, both the claim and the defence are fully pleaded at the outset. Under Part 8, on the other hand, the claim is not fully pleaded and the claimant's evidence is served alongside the claim form; the defendant responds in a similar manner, serving their evidence with their acknowledgement of service.
