Temporary Use Permits apply to property outside the public right- of-way only. A temporary use permit is not required for mobile vendors located outside of the DD District that are occupying private property within a commercial zoning district for four hours or less.

Temporary Food Establishment (TFE) permits are issued to food and drink vendors that operate in conjunction with a fair, festival or other special event. The NC State Fair, Apex PeakFest and Raleigh First Night, for example, are events that qualify for a TFE permit.

Permits are required for temporary special events within the City that are not more than 7 days. The following qualify as a TSE, provided they have a maximum duration of 7 consecutive days: Tents or canopies, larger than 450 square foot, on a residential property.

Temporary Use Permits are reviewed by the Durham City-County Planning Department. Efforts will be made to process complete applications within five business days. For applications that require multi-department review, the review time may exceed 5 days but will be completed within 30 days.

The Special Use Permit procedure is used to review applications for certain uses that, while not permitted by right in a zoning district, might be allowed following special consideration of the use's location, design, and methods of operation to address the impacts of the proposed use on surrounding development.

A temporary use permit is for a particular use which is not normally located at a particular site i.e., merchandise tent sale, agricultural sales or Christmas tree sales in a parking lot.
