Substitute decision-maker The person's spouse, de facto or same-sex partner, where there is a close and continuing relationship. A primary (unpaid) carer. A friend or relative who has a close personal relationship, frequent contact and a personal interest in the person's welfare.

What is an Advance Care Directive? An Advance Care Directive is a way to say what healthcare treatments you would like to have or refuse, should you be in a position where you are seriously ill or injured and unable to make or communicate decisions about your care and treatment.

Document signing must be witnessed by an eligible witness, either an Australian legal practitioner, Registrar of the NSW Local Court, overseas-registered foreign lawyer or approved employee of NSW Trustee & Guardian. The witness cannot be a person who is being appointed. More than one person can be appointed.

If you become unable to make decisions about your own health care, a substitute decision-maker will make decisions on your behalf. Your substitute decision-maker may be: Chosen and appointed by you â–  Appointed for you by a guardianship tribunal â–  Identified for you by a default list under legislation.

Substituted judgment is often invoked as a guide for decision making when a patient lacks decision making capacity and has no advance directive. Using substituted judgment, doctors and family members try to make the decision that the patient would have made if he or she were able to make decisions.
