This is any marriage in Arizona where the parties did not voluntary opt in to a covenant marriage. In other words, it is a marriage where the parties can seek a divorce for any reason. The fault provisions do not apply. Almost all marriages in Arizona are non-covenant marriages.

You would file your Petition for Dissolution of Marriage in the county where either you or your spouse lives. You will be required to pay a filing fee; although you may apply for the court to waive the filing fee.

Under Arizona law, legal grounds must be alleged to support a request for divorce from a covenant marriage unless the spouses agree to it. If the other spouse does not want to dissolve the marriage, then the Petitioner must allege and prove one of the following grounds for divorce: Adultery.

In Arizona, the legal name for a divorce is Dissolution of Marriage. The amount of time that takes to get a dissolution or divorce can vary from case to case. State laws require that you wait 60 days from the date of service before you can proceed with a divorce.

Default divorce can occur in any of the following situations: The filing spouse is unable to locate the ex-partner to serve the Petition for Dissolution of Marriage. The non-filing spouse ignores the petition or refuses to participate. Both ex-partners agree to enter a default judgment.

Steps of filing a Consent Decree: Wait at least 60 days from the date your spouse was served or signed an "Acceptance of Service " for the divorce papers before you file the Consent Decree. Sign the Consent Decree with your spouse in front of a Notary or a Clerk of the Court.
