In addition to the relationship between the parties, one of the distinguishing features of civil harassment restraining orders is the high burden of proof that the petitioner must meet for an order to issue after the hearing. The petitioner must prove all the elements of harassment by clear and convincing evidence.

Go to your court hearing. Take your copies of all your papers to your court hearing, including a copy of your proof of service. At the hearing, the judge will decide whether or not to change or end the restraining orders.

2.3. A person can ask for a civil harassment restraining order if: the person is being harassed, stalked, abused, or threatened by someone else, and. the person is not in a close relationship with the restrained party (as with domestic violence restraining orders).

In general, civil harassment is abuse, threats of abuse, stalking, sexual assault, or serious harassment by someone you have not dated and do NOT have a close family relationship with, like a neighbor, a roommate, or a friend (that you have never dated).

A civil harassment restraining order can be granted against someone who has harassed, stalked, threatened, or harmed another person emotionally or physically. What if I am under 18? If you are 12 or older, you can ask for a restraining order on your own and without your parent's permission.
