It is an offence at law to exhume any human remains or cremated remains without first obtaining the necessary lawful permission. The person requesting the exhumation should be advised to contact a Funeral Director to assist them. A licence must be obtained from the Ministry of Justice.

Reasons for exhuming a body You can only ask for an exhumation: to move a body the original grave to a family plot bought after the interment. to repatriate the body overseas for burial to with other family members. to transfer a body from a cemetery scheduled for development to another.

disinterred; disinterring; disinters To "inter" a body is to bury it or place it in a mausoleum, so to disinter someone is to take the body out again — usually to find out how they died, to make sure it's really who we think it is, or to move the body to a new burial site.

The removal of a dead body from the ground after it has been buried is known as exhumation.

The MoJ will normally grant exhumation licences to the next of kin, subject to any other necessary consent, where the application is made for private family reasons. We require details of the applicant, the deceased and place of burial.

Disinterment means to have a body exhumed and/or moved from one burial place to another. The Probate Court makes determinations about such requests based upon the information presented.

Acquiring an exhumation licence does not cost nothing, however, please be aware that there may be other charges you incur throughout the process. This usually comes to between £2,500 to £3,000 but costs can vary.

You will need to have consent from the owner of the burial grounds as well as all next of kin. If the procedure is going to be carried out in a public graveyard, where other remains may be buried and disturbed, the permission of the surviving relatives of those deceased are required also.
