The lowest level of the New Mexico state court system consists primarily of the New Mexico District Courts, the New Mexico Magistrate Courts, and the New Mexico Municipal Courts. The District Courts are trial courts with general jurisdiction over civil and criminal cases.

Courts in New Mexico's system include the State supreme court, the court of appeals, district courts, probate courts, small claims court, municipal courts, and magistrate courts.

There are three types of constitutional courts: federal district courts, federal appellate courts, and the United States Supreme Court. Constitutional courts exercise the judicial powers found in Article III of the Constitution. Judges in these courts are given special protection directly by the Constitution.

The federal court system has three main levels: district courts (the trial court), circuit courts which are the first level of appeal, and the Supreme Court of the United States, the final level of appeal in the federal system.

e-Filing system enables electronic filing of legal papers. Using e-filing, cases (both civil and criminal) can be filed before the High Courts and District Courts that have adopted e-Filing systems.

To file a lawsuit you must fill out a Civil Complaint form, which can be obtained from: Customer Service on the 1st floor of the Courthouse; The Self-Help Center; or. The Metropolitan Court website. (.metrocourt.state.nm.us)

To obtain a case number, interested persons must request it from the court clerk where the cases were filed. This may be done online by utilizing the New Mexico Courts CaseLookup application. For in-person requests, visit the office physically or mail a request addressed to the court clerk's office.

In New Mexico, there is one federal district court, a state supreme court, a state court of appeals, and trial courts with both general and limited jurisdiction.
