Regulations. The National Institute for Occupational Safety and Health (NIOSH) is responsible for conducting research and making recommendations for the prevention of work-related injury and illness.

NIOSH approval is issued only to a specific and complete respirator assembly after the respirator has been evaluated in the laboratory and found to comply with all of the requirements of Title 42, Code of Federal Regulations , Part 84, and after the manufacturer's quality plan is determined to be satisfactory.

NIOSH Certification is possible only after successful testing of the device and following the conduct of Quality Audit at a manufacturing location to get the final certificate. The NIOSH Certification authority only can issue a certificate, not by any third-party agency.

NIOSH has developed a new set of regulations in 42 CFR* 84 (also referred to as “Part 84”) for testing and certifying nonpowered, air-purifying, particulate-filter respirators.

Once you obtain a manufacturer code, NIOSH will send you the Standard Application Form to submit a single approval request for a new respirator. All required documentation (including the Quality Manual), test samples and appropriate fees, as detailed in the Standard Application Procedures must be provided.

You may see some respirators on the market labeled as “N95,” but if a respirator does not contain all of the components of the required label, it is not a NIOSH-approved respirator and, therefore, cannot be relied on to provide the same level of respiratory protection.

Ninety-five percent is the minimal level of filtration that will be approved by NIOSH. The N, R, and P designations refer to the filter's oil resistance as described below. Select a type of respirator to see all approved models: N95 – Filters at least 95% of airborne particles.

How long does it take to achieve NIOSH approval? During normal operations, the total time from start to finish can range from one month to nine months depending on application issues and any non-conformances identified during the application review or initial site visit.
