Technically, you can refuse to be served papers. It isn't illegal to run away from a process server, but it isn't advisable either. There are negative consequences when you refuse to be served the appropriate paperwork. First, you can't run away from a lawsuit.

Any person who is at least 18 years old and not involved in the case may serve papers. The person who serves the papers will have to fill out a Proof of Service form showing what they gave (served) to the other parties. Choose someone to serve the papers who is able to fill out the form.

The state of California requires process servers to prove they have attempted personal service three times on three different days before subservice can occur.

If the papers are not served in the correct way at the correct time, the court cannot go forward with the case. A person is served when they officially receive the papers. Papers which start an action (Summons, Petition, Request for Order, etc) must be filed first and then served on the other person(s).

If the party being served is a person, the papers can be mailed to his or her home or mailing address. If it is a business, the papers must be mailed to the owner(s) at the business's main office. If the business has an agent for service, the papers should be mailed to the agent for service.

While process servers may not legally enter a building, they may leave a summons taped outside of your door, as long as it does not display the contents.

After three attempts have been made, your server can subserve the documents by leaving them in the possession of anyone over the age of 18 provided there is a reasonable expectation that they will deliver the documents on your behalf (co-habitant, relative, coworker).
