You, the plaintiff, must file a “Statement of Claim” form, available at your Clerk's office. This must be fully completed and signed to receive a pre-trial conference date. If your claim is based upon written documentation, attach a copy of the contract to the Statement of Claim form. You may file by mail or in person.

County Civil Court Records A civil cover sheet must be filed specifying the dollar amount in dispute in cases exceeding $8,000 in value. Small Claims is a separate division of the County Court and has jurisdiction where damages do not exceed $8,000 exclusive of costs, interest or attorney fees.

In general, claims are limited to disputes up to $5,000. However, natural persons (individuals) can claim up to $10,000. Corporations, partnerships, unincorporated associations, governmental bodies, and other legal entities cannot claim more than $5,000.

How long you have to file a claim in court, notably Small Claims Court, varies depending on the topic and circumstances of the respective litigation. Chapter 95.11, Florida Statutes, explains that a person has between one and five years.

A claim up to $5,000 (not including costs, interest and attorney's fees) can be filed with the Clerk of Courts as a Small Claims Action ing to Rule 7.010 of the Florida Rules of Court. When can you file a Small Claims Action?
