The Wage Theft Prevention Act (WTPA) requires employers to give written notice of wage rates to each new hire. The notice must be given in English and in the employee's primary language (if the New York State Department of Labor (NYDOL) offers a translation).

New York employers are required to pay most hourly employees via a regular payday at least weekly or semimonthly. In New York, there are mandatory weekly paydays for manual workers. Semi-monthly payday is permitted upon approval for manual workers and for clerical and other workers.

New York employers who make an untimely wage payment may do so in violation of state and federal laws. Employers must pay their employees within seven days of their particular pay period, whether it is on a weekly or biweekly basis. While some exceptions exist, most employers cannot engage in untimely wage payments.

Notice and Acknowledgement of Pay Rate and Payday Under Section 195.1 of the New York State Labor Law Notice for Hourly Rate Employees LS 54 is a blank work agreement that contains all of the fields that employers must include to notify each employee in writing of conditions of employment at time of commitment to hire.

Labor Law Section 191 outlines the frequency by which employees must be paid. Manual Workers: Wages must be paid weekly and not later than seven calendar days after the end of the week in which the wages are earned.

Section 190(4) of the Labor Law defines a “railroad worker” as any person employed by an employer who operates a steam, electric, or diesel surface railroad or is engaged in the sleeping car business. The term "railroad worker" does not include a person employed in an executive capacity.

New York law provides employees with the right to pursue their unpaid wages in court. This is done through the Wage Theft Act. Under this Act, employers are required to provide written wage notices and pay stubs or face penalties as high as ten thousand dollars.
