Third Level of Appeal: Decision by Office of Medicare Hearings and Appeals (OMHA) Any party that is dissatisfied with the Qualified Independent Contractor's (QIC's) reconsideration decision may request a hearing before an Administrative Law Judge (ALJ) with the Office of Medicare Hearings and Appeals (OMHA).

To get a judicial review in federal district court, the amount of your case must meet a minimum dollar amount. For 2024, the minimum dollar amount is $1,840.

(1) The appellant must send a copy of the request for hearing or request for review of a QIC dismissal to the other parties who were sent a copy of the QIC's reconsideration or dismissal.

If you disagree with the outcome of your Level 2 appeal (called a reconsideration or reconsidered determination), you or your representative can request the dismissal or decision be reviewed by an OMHA adjudicator.
